Terms of Sale

These Terms govern the supply of PEM hydrogen combustion enhancement systems and related goods (the “Products”) by YBG Group International Pty Ltd (ABN 22 636 934 999), trading as Hydrogen Machines Australia (“we”, “us”), to the buyer named on the order or quotation (“you”).
1. Quotation & order
Prices displayed on the site are indicative until confirmed in a written quotation. A firm quotation is valid for 14 days from issue. An order is accepted when we issue a written order confirmation.
2. Price, payment & currency
Prices are quoted in the currency shown on the quotation and include freight to the delivery address. Customs duties and local taxes are treated as set out in section 4 below. Payment terms are stated on the quotation; ownership of the Products does not pass to you until payment is received in full.
3. Delivery & risk
We arrange tracked, insured freight to the delivery address shown on the order. Risk in the Products passes to you on delivery. Delivery timeframes are estimates and not conditions of the contract; we are not liable for losses arising from delays caused by carriers, customs authorities, force majeure or events outside our reasonable control.
4. Customs duties & local taxes
For destinations where the carrier accepts pre-payment (Delivered Duty Paid, DDP), we prepay customs duties and local taxes before dispatch and the price shown is the final landed price into your country. For destinations where pre-payment is not permitted, the carrier collects applicable duties and taxes from the consignee on arrival; we will notify you by email when the shipment clears customs into your country, before any payment is requested. The per-country position is set out at /shipping#duties-by-country. Any country not listed defaults to duties payable on arrival.
5. Acceptance & inspection
You must inspect the Products on receipt and notify us within 7 days of any visible transit damage, missing items or shortfalls, with supporting photographs. Claims notified after this period may be rejected.
6. Installation & use
You are responsible for installation in accordance with the supplied installation guide, for ensuring the host vehicle, generator or engine is suitable, and for compliance with all local registration, roadworthiness and electrical regulations applicable to your jurisdiction.
7. Warranty & returns
Goods are supplied with a 12-month limited warranty as set out on the Warranty page, and the returns policy at /returns applies. These terms do not exclude, restrict or modify any consumer guarantees that apply under the Australian Consumer Law or any equivalent non-excludable rights in your jurisdiction.
8. Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with the supply of the Products is limited to the price paid for the Products giving rise to the claim. We are not liable for indirect, incidental or consequential loss, including lost revenue, lost profit, or downtime.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
